PhysioWorkplace Terms of Use

These terms apply when you:

• create or use a professional PhysioWorkplace account,
• use PhysioWorkplace code to embed a public exercise, or
• use another feature that expressly refers to these terms.

Simply visiting or reading a public page does not make you a customer of Meadow Arc.

Professional users actively accept these terms when an account is created or first used. Anyone using PhysioWorkplace embed code may use the material only on the terms set out in section 4.

PhysioWorkplace is provided by Meadow Arc AB. In these terms, the company is also referred to as Meadow Arc, PhysioWorkplace, we or us.

1. About PhysioWorkplace

PhysioWorkplace is a digital working tool for physiotherapists and other professionals working with exercises, exercise programmes and rehabilitation.

Organisations that purchase PhysioWorkplace are also subject to a separate customer agreement and order. Those documents cover matters such as price, subscription, modules, support and the handling of customer data. For matters governed by the customer agreement, it takes precedence over these terms of use.

Patients and other recipients may receive access to exercises, programmes or patient features through an organisation that uses PhysioWorkplace. This does not make them customers of Meadow Arc, and they are not responsible for the organisation’s payments or other commercial obligations. This also applies to patients who are under 18.

For personal patient features, the brief information and usage rules shown as part of the patient flow apply.

2. Accounts and permitted use

An account is personal and may only be used by the person for whom it was created.

You must:

• provide accurate information,
• protect your sign-in and security methods,
• only access and manage accounts, workplaces, patient records and information that you are authorised to use,
• follow the roles and permissions assigned to you by your organisation, and
• notify your organisation or PhysioWorkplace if you suspect unauthorised access.

Personal invitation, sign-in and account-recovery links may only be shared with their intended recipient.

You must not:

• attempt to gain unauthorised access to accounts, information or systems,
• investigate, bypass or interfere with security features,
• use the service for unlawful purposes,
• impersonate another person,
• distribute malicious code or disrupt the service, or
• use the service to send unsolicited messages.

Patient data, clinical data and other sensitive information must not be entered in email subject lines, general support forms, public fields or other places not intended for that information.

3. Professional and clinical responsibility

PhysioWorkplace supports professional workflows but does not replace physiotherapy or medical assessment.

The professional user and the organisation using PhysioWorkplace are responsible for their own clinical and professional decisions, including:

• assessing the patient’s needs and circumstances,
• selecting and adapting exercises and programmes,
• dosage, instructions and precautions, and
• following up and changing programmes.

Public exercises provide general information and examples of how a movement may be performed. They are not personalised medical recommendations and do not mean that a particular exercise is suitable for everyone.

PhysioWorkplace is not an emergency service and is not used for continuous monitoring. In the event of acute symptoms or immediate danger, the appropriate healthcare or emergency service should be contacted.

4. Public exercises and sharing

Some exercises are made available on public PhysioWorkplace pages.

You may:

• link to a public exercise page, and
• display a public exercise on a website using embed code provided by PhysioWorkplace.

You may use several embedded exercises as a normal part of, for example, a clinic’s website, an education provider’s website or another information website.

The embed feature gives you a limited, free-of-charge and non-exclusive right to display the relevant exercise through PhysioWorkplace. No ownership or other rights in the images or other material are transferred to you.

Without separate permission, you must not:

• copy, download or use screenshots of the images for republication or distribution,
• upload the material to your own server or another service,
• link directly to image files instead of linking to the exercise page or using the embed feature,
• alter the exercise content shown in the embed,
• remove or obscure the PhysioWorkplace name, branding or links,
• present the material as though you created or own it,
• suggest that Meadow Arc endorses or works with you unless this has been agreed,
• retrieve content automatically or systematically in order to recreate all or a substantial part of the exercise library, or
• use the material in an unlawful or misleading context.

Embedded exercises must not be used to create a standalone or competing exercise library.

This section does not restrict use that is expressly permitted through another PhysioWorkplace feature, a customer agreement, separate written permission or mandatory law.

When an embedded exercise is displayed, the visitor’s browser retrieves content from PhysioWorkplace. The person or organisation embedding the exercise is responsible for any information and consent requirements that apply to their own website. Meadow Arc’s processing is described in the PhysioWorkplace Privacy Policy.

PhysioWorkplace may update or remove a public exercise. We may also disable an embed if these terms are breached or if this is required for security, legal or technical reasons.

5. Rights and content

Meadow Arc or its licensors hold any applicable rights in the PhysioWorkplace software, trade marks, text, selection, structure, design and composition of the exercise cards. Different parts of the material may be protected in different ways.

Making material publicly available does not transfer any rights. The rights granted by Meadow Arc to link to and embed public exercises are set out in section 4.

You and your organisation retain any rights you hold in material that you add to PhysioWorkplace. You are responsible for ensuring that you have the right and authority to provide that material to the service.

Meadow Arc may only use such material to the extent necessary to:

• provide and protect the service,
• store and back up the material,
• display the material to authorised recipients,
• provide support, and
• comply with legal obligations.

Meadow Arc does not acquire ownership of the material.

Suspected unlawful content or infringement may be reported to support@physioworkplace.com. Please identify where the content can be found and explain why you believe it is unlawful or infringes another person’s rights.

6. Personal data

The PhysioWorkplace Privacy Policy explains how Meadow Arc processes personal data in connection with accounts, security, support and website use.

When a healthcare provider or another organisation uses PhysioWorkplace for patient or staff data, the organisation is normally the data controller. Meadow Arc then processes the data as a processor under the organisation’s instructions and data processing agreement.

Questions and requests concerning patient data should therefore normally be addressed to the organisation that gave the patient access to PhysioWorkplace.

7. Availability and suspension

PhysioWorkplace may change and be updated over time. The service may occasionally be restricted or unavailable because of maintenance, fault resolution or security measures.

A specific commitment concerning availability, support hours or service levels only applies if it is set out in the organisation’s customer agreement or order.

Meadow Arc may restrict or suspend access if:

• the service is used in breach of these terms,
• this is necessary to protect users, information or the service,
• this is required by law or a public authority, or
• the organisation’s right to use the service has ended.

Where reasonable and possible, we will inform the affected user or organisation.

A professional user may stop using the service at any time. An account may be closed through the organisation’s administrator or PhysioWorkplace support, subject to the customer agreement and applicable data-retention requirements.

8. Responsibility and liability

The professional user and the organisation are responsible for their clinical decisions, including the selection, adaptation and prescription of exercises and programmes.

An external website is responsible for any instructions, claims or other content that it places around an embedded exercise.

Meadow Arc is responsible for its own obligations under applicable law and the customer agreement governing the organisation’s use of the service.

Nothing in these terms limits any responsibility, liability or rights that cannot be limited by law.

9. Changes to these terms

We may update these terms when the service, the law or the way PhysioWorkplace is used changes.

Registered users will be informed appropriately about material changes. A new active acceptance will be requested where required.

Material changes to the embed rules will also be shown where the embed code is provided, where possible. Anyone who does not accept the new rules must stop using and remove the embed when the change takes effect.

The current version and its effective date will always be available on this page.

The language versions are intended to have the same meaning. The Swedish version is the original version. If a translation differs from or is unclear in relation to the Swedish version, the Swedish version will be used as an aid to interpretation. This does not limit any rights under mandatory law.

Swedish law applies to these terms unless mandatory law provides otherwise.

Disputes concerning an organisation’s purchase or subscription are handled under the organisation’s customer agreement.
